This website is operated by Pure Alabaster (operated by Aurelian Home Inc, “we”, “us”, or “our”). Throughout the site, the terms “we”, “us” and “our” refer to Pure Alabaster. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein and/or available by hyperlink (collectively, the “Policies”), including without limitation our Return & Refund Policy, Shipping Policy, and Privacy Policy. These Terms of Service apply to all users of the site without limitation.

1.2 Lawful Use: You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.
1.3 No Malware: You must not transmit any worms, viruses, or any code of a destructive nature.
1.4 Service Termination: A breach or violation of any of the Terms will result in an immediate termination of your Services and store access.

SECTION 2 – GENERAL CONDITIONS

2.1 Right to Refuse: We reserve the right to refuse service or cancel orders in cases of suspected fraudulent transactions, billing discrepancies, payment verification issues, abuse of our store policies, or violations of these Terms of Service, to the fullest extent permitted by applicable law.
2.2 Data Encryption: You understand that your content, not including sensitive payment card numbers or billing credentials, may be transferred over various networks as part of normal website operation. We do not collect, store, or process sensitive payment card numbers on our servers. Payment transactions are encrypted and processed securely through our authorized PCI-compliant checkout partners.
2.3 Commercial Restrictions: Commercial Restrictions: You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service or product display without express written permission from us.

SECTION 3 – PAYMENT & TRANSPARENCY POLICY

3.1 Accepted Payment Methods: We accept major credit cards (Visa, MasterCard, American Express, Discover) as well as secure digital gateways including Apple Pay, Google Pay, PayPal, and Shopify Pay.
3.2 Immediate Capture: Payment is fully processed and captured at the time you place your order. A formal receipt and electronic invoice will be dispatched immediately to the email address provided at checkout.
3.3 Pricing Currency: All prices throughout the site are strictly listed in United States Dollars (USD).
3.4 Taxes: Applicable sales taxes will be calculated dynamically based on regional state regulations and fully displayed at checkout. There are no hidden fees or unexpected post-purchase charges.
3.5 Order Cancellations & Modification Window: Because our logistics team initiates secure crating swiftly, you may request changes or cancellations strictly within 12 hours of placing your order by emailing support@purealabaster.com. Beyond 12 hours, the order enters our 2-3 day processing queue and must be handled under our Return & Refund Policy.
3.6 Payment Disputes: In the event of a billing discrepancy, you agree to contact us first so we may resolve the issue internally and coordinate with carrier investigations where applicable. We reserve the right to contest fraudulent chargebacks to the fullest extent permitted by law.

SECTION 4 – SHIPPING & FREIGHT INTEGRITY

4.1 Rates & Framework:

In full alignment with our standalone Shipping Policy, we use a transparent flat-fee system within the contiguous United States:
- Orders totaling $500 and over qualify for Free Standard Shipping.
- Orders under $500 will incur a flat shipping fee of $50 applied at checkout.
4.2 Processing & Transit Hours:

All premium alabaster products require 2 to 3 business days for quality inspection and protective packaging before shipment.

After dispatch, standard domestic transit time is typically 3 to 7 business days.

Estimated total delivery time is typically 5 to 10 business days.
4.3 Logistics Transparency:

Our registered corporate address is 931 N Royer St, Colorado Springs, CO 80903. Orders are packaged and dispatched from our authorized logistics facility at 10 Webb Drive, Londonderry, NH 03053.
4.4 Address Verification:

Address Verification: Please review your shipping address carefully before submitting your order. If a package is returned due to an incorrect address, delivery refusal, or failure to receive the shipment, the order may be treated as a customer remorse return under our Return & Refund Policy. A flat 10% handling and restocking fee may apply.

If re-shipment is requested, additional shipping charges may apply and will be confirmed before dispatch.

SECTION 5 – PRODUCTS AND NATURAL VARIATIONS

5.1 Availability: Certain high-end stone items may be limited in quantity and are subject to availability.
5.2 Natural Characteristics: Alabaster is a premium, 100% natural stone material. Minor natural variations in veining, opacity, coloration, and texture are inherent characteristics of natural stone and do not constitute manufacturing defects.
5.3 Installation Duty: All electrical fixtures or stone fittings must be tested prior to permanent mounting. Any damages resulting from incorrect third-party installation are excluded from warranty remedies.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFO

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email address provided at the time the order was made.

SECTION 7 – THIRD-PARTY LINKS & TOOLS

We are not liable for any third-party tools, links, or resources integrated into the site. Please review the third party's policies and practices carefully before you engage in any transaction.

SECTION 8 – USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you send specific creative submissions (for example, product reviews or testimonials), you grant us an unrestricted, royalty-free, worldwide license to edit, copy, publish, and distribute those materials. This license strictly excludes personal transactional details (such as shipping or billing addresses), which are handled under our Privacy Policy.

In no case shall Pure Alabaster, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits or installation labor fees, arising from your use of the service or any products procured using the service.

You agree to indemnify, defend, and hold harmless Pure Alabaster and our parent, subsidiaries, affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.

SECTION 12 – GOVERNING LAW AND JURISDICTION

12.1 Governing Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles.
12.2 Venue: Any formal legal action, dispute resolution, or individual arbitration proceedings arising from these Terms shall take place exclusively within the state courts or federal jurisdictions located in Colorado Springs, Colorado.
